You acknowledge and agree that, as provided in greater detail in these Terms:
▪️OUR SERVICE IS NOT INTENDED FOR EMERGENCY SITUATIONS. IN THE EVENT OF A MEDICAL EMERGENCY, PLEASE CALL 911 OR APPROPRIATE Local EMERGENCY RESPONDERS.
▪️Nutrinex may make unilateral modifications to these Terms.
▪️Nutrinex is your medical nutrition advice provider. If you need any other health care assistant Nutrinex is not bound to provide them. however Nutrinex through the Service may connect you with a Provider.
Summary of Terms & Privacy Policy –
1) We own the Service but you may use them in accordance with these Terms. Please do not attempt to interfere with our provision of the Service.
2) The Service may involve helping you obtain telehealth consultations and treatment. Telehealth services may involve certain risks.
3) You may be subject to additional payment terms depending on whether you are a health plan, employer provider, or individual user. If you have elected to pay for the Service on a monthly basis, your monthly charges will automatically be billed each month unless you provide notice to us in writing.
4) Using the Service requires appropriate software and hardware, which you are responsible for providing and maintaining.
5) The Service may include or display links to content, applications, websites, or other services from third parties. We’re not responsible for such content, applications, websites, or other services.
6) Discontinuation and Modification of the Service. We may terminate your use of the Service at any time, including if you misuse the Service or otherwise violate these Terms. You may also terminate your account.
7) We may change the Terms from time to time. Whenever we materially change the Terms, we’ll update the “Last Updated” date at the top. If you don’t like the changes, please stop using the Service.
8) Nutrinex owns and operates the Service. You may only use the Service and related content in accordance with the rights we give you in these Terms.
9) We do not provide health care and do not form a health care provider-patient relationship with any users. Our content should not be construed as medical advice.
10) We make reasonable efforts to protect the security of your information. Certain communication methods such as email or text message are not secure and may be read by third parties.
11) We make no guarantees about the Service. If you experience a medical emergency, you should call 911 or your local emergency number instead of using the Service.
12) We aren’t responsible for damages or losses arising from your use of the Service or otherwise arising from your violation of these Terms. Disagreements between Users. We’re not responsible for any communications you have with other users, but we may monitor such communications.
13) User-provided Information. When you use the Service, you may provide and we may collect what is generally called “personally identifiable information,” or “personal information,” which is information that specifically identifies an individual. You may provide us with personal information of various types and in various ways on the Service, including, without limitation, when you register for an account, use the Service, post or share User Content (as defined in the Terms), make a purchase on the Service, interact with other users of the Service through communication or messaging features, send us customer service-related requests, or otherwise communicate with us. For example, when you register for the Service, we collect your name, email address, phone number, date of birth and information about what interests you about our Service. We may also collect additional information when you continue to use the Service, including without limitation, your mailing address, a username, and password and other information that may identify you, such as, gender, age, social security number, driver’s license number, geographic area, preferences, payment information (such as your payment card number, expiration date, and billing address), and insurance information. We may also receive health information from you or on your behalf such as information or records relating to your medical or health history, health status and laboratory testing results, diagnostic images, and other health-related information. Please remember that Nutrinex may, but has no obligation to, monitor, record, and store User Content in order to protect your safety or the safety of other users, to assist with regulatory or law enforcement efforts, or to protect and defend our rights and property. By using the Service, you consent to the recording, storage, and disclosure of such communications you send or receive for these purposes
14) We also reserve the right to disclose your information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability; (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity; (iii) investigate and defend ourselves against any third-party claims or allegations; (iv) protect the security or integrity of the Service and any facilities or equipment used to make the Service available; or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements and Terms), or the rights, property, or safety of others;
15) You may, of course, decline to share certain personal information with us, in which case we may not be able to provide to you some of the features and functionality of the Service. You may update, correct, or delete your profile information and preferences at any time by accessing your account preferences page on the Service. You may request that we provide to you the information we hold about you, update your information, request that we remove your name or comments from our Service or publicly displayed content or request that we delete your information or correct any inaccuracies by emailing us at [email protected] with the subject heading “personal information request.” Please note that while any changes you make will be reflected in active user databases within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. We may not be able to modify or delete your information in all circumstances.
16) You may ask us to contact you at a specific phone number or to send mail or notices to a specific mailing address or email address. If you receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt out from receiving commercial email from us, and any other promotional communications that we may send to you from time to time, by sending your request to us by email at [email protected] or by writing to us at the address given at the end of this Policy. We may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in user account functionality on the Service.
17) Please be aware that if you opt out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten (10) business days for us to process your request, and you may receive promotional communications from us that you have opted out from during that period. Additionally, even after you opt out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Service.
18) Social Media Widgets and Advertising. Our Service may include social media features, such as the Facebook Like button, LinkedIn, Snapchat, Instagram, Twitter, or other widgets. These social media companies may recognize you and collect information about your visit to our Service, and they may set a cookie or employ other tracking technologies. Your interactions with those features are governed by the privacy policies of those companies.
19) We may display targeted advertising to you through social media platforms, such as Facebook, Twitter and others. These companies have interest-based advertising programs that allow us to direct advertisements to users who have shown interest in our Service while those users are on the social media platform or to groups of other users who share similar traits, such as likely commercial interests and demographics. These advertisements are governed by the privacy policies of those social media companies that provide them.
20) Protecting the privacy of young children is especially important. Our Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13 without obtaining parental consent. If you are under 13 years of age, then please do not use or access the Service at any time or in any manner. If we learn that a person under 13 years of age has used or accessed the Service or any personally identifiable information has been collected on the Service from persons under 13 years of age, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 13 years of age has obtained an account on or otherwise accessed the Service, then you may alert us at [email protected] and request that we delete that child’s personally identifiable information from our systems.
21) Payments done for appointments and packages are non refundable.
